再审申请人***因与被申请人中国十五冶金建设集团有限公司（以下简称十五冶金公司）、湖北中南四海建设工程有限公司（以下简称中南四海公司）、许其东建设工程施工合同纠纷一案，不服新疆维吾尔自治区高级人民法院伊犁哈萨克自治州分院（2020）新40民终1857号民事判决，向本院申请再审。本院依法组成合议庭进行了审查，现已审查终结。

***申请再审称，一、原审判决认定了涉案工程存在层层转包的事实，也确认工程实际施工的事实，***前面几手的转包人根本就没有施工，仅是以合同形式层层转包，只有***对涉案工程进行了实际施工，***前几手转包人之间进行的所谓工程款结算全部都是***应得的工程款。原审以2011年6月3日签订《工程转包协议》，同年6月9日涉案工程被停止施工，认定***没有实际施工，不应得到工程款，明显存在矛盾之处。二、十五冶金公司与中南四海公司之间对于涉案工程应付工程款的数额已经确定，十五冶金公司认可与中南四海公司之间的结算值为1004713.34元，***在原审案件中主张的工程款应当得到支持。综上，原审判决认定事实缺乏证据支持，请求依法再审本案。

本院经审查认为，本案中，原审法院依据涉案2011年6月3日《工程转包协议》确定***在上述协议签订后为实际施工人，有事实依据。原审法院现已查明，总承包人十五冶金公司与分包人中南四海公司及许其东等人之间就涉案施工已经结算完毕，十五冶金公司亦已向中南四海公司及许其东等人支付完毕全部工程款项。原审庭审中，十五冶金公司及中南四海公司对***实际施工人的身份不予认可，并当庭否认涉案工程是由***实际施工。本案原审期间，许其东始终未参加诉讼。***既无有效证据证实在与许其东签订上述协议之前，就已经以实际施工人身份对涉案工程进行了施工，亦无有效证据证实曾以实际施工人的身份直接与十五冶金公司或者中南四海公司进行过工程款项的支付结算，也没有证据证实在签订上述协议之后，曾对涉案工程进行了施工。原审法院依据上述事实，依法对***的诉讼请求未予支持，并无不当。本院再审审查期间，***未依法提交新证据证明其主张成立。综上，***的再审申请无事实及法律依据。

依照《中华人民共和国民事诉讼法》第二百零四条第一款，《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第三百九十五条第二款规定，裁定如下：
