乌鲁木齐天洁仁和劳务派遣有限公司申请请求：请求撤销乌鲁木齐市天山区劳动人事争议仲裁委员会作出的天劳人仲字（2020）第798号仲裁裁决。事实和理由：仲裁裁决的重要依据为乌鲁木齐劳监2019020391号《初次复查鉴定结论书》，而该鉴定结论在***伤情没有稳定的情况下作出的，没有客观真实的反映***的伤情。因此，乌鲁木齐市天山区劳动人事争议仲裁委员会依据该鉴定结论裁决我公司支付***各项工伤待遇，属于程序违法。

***辩称，乌鲁木齐天洁仁和劳务派遣有限公司撤销劳动仲裁裁决的理由为依据的证据有误，而法律规定撤销的条件是裁决所依据的证据是伪造的。但鉴定结论系行政部门作出的，且乌鲁木齐天洁仁和劳务派遣有限公司在鉴定结论作出后，并未在收到结论书之日起15日内申请复议。因此，乌鲁木齐天洁仁和劳务派遣有限公司申请撤销仲裁裁决不符合法律规定，请求法院依法驳回。

经审查查明：2020年11月2日，乌鲁木齐市天山区劳动人事争议仲裁委员会作出的天劳人仲字（2020）第798号仲裁裁决：一、乌鲁木齐天洁仁和劳务派遣有限公司支付***伙食补助费5985元（342天×25元／天×70％）；二、乌鲁木齐天洁仁和劳务派遣有限公司支付***护理费54317.75元（2510元／月÷21.75天×147天＋2933元／月÷21.75天×277天）；三、乌鲁木齐天洁仁和劳务派遣有限公司支付***配置辅助器具费用984.89元、劳动能力鉴定费用300元、医疗检查费用628元；四、乌鲁木齐天洁仁和劳务派遣有限公司支付***一次性伤残补助金28600元（2200元×13个月）、一次性工伤医疗补助金49797元（5533元／月×9个月）、一次性就业补助金116193元（5533元／月×21个月）；五、驳回***其它仲裁请求。

另查明：2019年7月20日经乌鲁木齐市人力资源和社会保障局认定***受伤为工伤，2019年11月7日乌鲁木齐劳动能力鉴定委员会作出乌鲁木齐劳监2019020391号《初次复查鉴定结论书》，鉴定***为工伤柒级。

本院认为，《中华人民共和国社会保险法》第三十六条第一款规定：“职工因工伤原因受到事故伤害或者患职业病，且经工伤认定的，享受工伤保险待遇；其中，经劳动能力鉴定丧失劳动能力的，享受伤残待遇。”据此，劳动者因工伤原因经劳动能力鉴定丧失劳动能力的，享受伤残待遇。本案中，***因工伤经乌鲁木齐劳动能力鉴定委员会作出乌鲁木齐劳监2019020391号《初次复查鉴定结论书》，鉴定为工伤柒级伤残。乌鲁木齐天洁仁和劳务派遣有限公司对该鉴定结论有异议，但未在法定期间内向相关部门申请复议，目前该结论并未被撤销。乌鲁木齐市天山区劳动人事争议仲裁委员会依据***伤残柒级的鉴定结论裁决乌鲁木齐天洁仁和劳务派遣有限公司支付***各项工伤待遇并不存在程序违法的情形，故乌鲁木齐天洁仁和劳务派遣有限公司申请撤销的理由，不符合法律规定，本院予以驳回。依照《中华人民共和国劳动争议调解仲裁法》第四十七条规定，裁定如下：
